Terms of Service

1.1These Terms of Service (“Terms”) form a binding agreement between you and Freezy (“Freezy”, “we”, “us” or “our”) governing your use of the Freezy mobile application, the website at planfreezy.com and all related services (the “Services”).

1.2By creating an account or using the Services you accept these Terms. If you do not accept them, do not use the Services.

1.3Our Privacy Policy and our Cancellation & Refund Policy form part of these Terms. Where the Cancellation & Refund Policy addresses a payment question, it prevails over these Terms.

2.1You must be at least 18 years old and capable of entering a contract under the Indian Contract Act, 1872 to use the Services.

2.2The Services are offered for personal, non-commercial use. You may not resell, redistribute or republish the plans we generate for you.

3.1You must give accurate information when registering and keep it current. The preferences you provide drive the plans you receive, so inaccurate information mainly produces poor plans.

3.2You are responsible for keeping your password confidential and for activity under your account. Tell us at hello@planfreezy.com if you believe your account has been used without your authorisation.

3.3One account is for one household unit as described by the plan you choose. Sharing account credentials outside that unit is a breach of these Terms.

3.4You may delete your account at any time, from the app or at planfreezy.com/delete-account. Deletion is irreversible and removes your plans and history.

4.1Freezy generates suggested weekend plans based on the profile, preferences, budget and availability you give us, along with what we learn from your feedback. Plans are produced in weekly batches, not on demand.

4.2Plans are suggestions. We do not make reservations on your behalf, we are not a travel agent or tour operator, and we are not a party to any transaction between you and a venue, event organiser or other third party.

4.3Parts of the Services use automated systems, including large language models, to select and describe activities. Automated output can be wrong. Check anything that matters — opening hours, prices, age limits, accessibility — before you rely on it.

4.4We may add, change or withdraw features. Where a change materially reduces what a paid subscription provides, clause 15 applies.

5.1Freezy currently plans for Bengaluru and the surrounding area only. If your home location is outside that area we will tell you in the app, we will not sell you a subscription, and you will not receive weekly plans.

5.2You may optionally share your home location once so that we can leave out venues on your doorstep. We do not track your location in the background. What we store and why is set out in the Privacy Policy.

6.1Some features require a paid subscription. Payment is taken through Razorpay on planfreezy.com. We do not receive or store your card details.

6.2Subscriptions are billed in advance for a 30-day period and renew automatically until cancelled. The price shown before payment is the price charged.

6.3You may cancel at any time from the app. Cancelling stops future charges and does not shorten the period already paid for. Refunds are governed by our Cancellation & Refund Policy.

6.4You are responsible for any costs you incur while following a plan — tickets, food, travel and the like. Prices we display are indicative and set by third parties, not by us.

7.1You must not:

• (a)Use the Services for any unlawful purpose, or to plan or facilitate anything unlawful.
• (b)Attempt to gain unauthorised access to the Services, other accounts, or our systems.
• (c)Scrape, crawl or bulk-extract venue data, plans or other content from the Services.
• (d)Reverse engineer the Services, or use them to build a competing product.
• (e)Submit content that is unlawful, abusive, defamatory, obscene, or infringes another person’s rights.
• (f)Interfere with the Services, including by overloading, disrupting or circumventing rate limits.
• (g)Impersonate another person or misrepresent your affiliation with anyone.

7.2We may investigate suspected breaches and take the action set out in clause 11.

8.1You keep ownership of what you submit — messages to Vibby, ratings, notes and preferences. You grant us a non-exclusive, worldwide, royalty-free licence to use it for the purpose of operating and improving the Services.

8.2If you send us suggestions about the Services, we may use them without obligation or payment to you.

9.1Venues, events and merchants referenced in plans are independent third parties. We do not control them and we do not warrant their quality, safety, availability, pricing or conduct.

9.2Any contract you enter with a third party is between you and that third party. Complaints about a venue should be raised with the venue, although we would like to hear about it too.

10.1The Services, including the software, interface, branding and the curated plan content, are owned by Freezy and protected by law. These Terms grant you a limited, personal, non-transferable, revocable licence to use the Services — nothing more.

10.2You may use the plans generated for you for your own personal purposes. You may not sell, syndicate or publish them as a product.

11.1We may suspend or terminate your access if you breach these Terms, if required by law, or where necessary to protect the Services or other users. Where practicable we will tell you the reason first.

11.2No refund is due for the remainder of a paid period ended for breach. If we terminate for any other reason, clause 6 of the Cancellation & Refund Policy applies.

11.3Clauses 8 to 14 and 16 survive termination.

12.1The Services are provided on an “as is” and “as available” basis. To the extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

12.2We do not warrant that the Services will be uninterrupted or error-free, that plans will suit your taste, or that any activity we suggest will be available, open, safe or suitable for you. You decide what to do with a suggestion, and you do so at your own risk.

13.1To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or opportunity, arising from your use of the Services.

13.2Our total aggregate liability arising out of or in connection with these Terms is limited to the amount you paid us in the 3 months immediately before the event giving rise to the claim, or ₹1,000, whichever is greater.

13.3Nothing in these Terms excludes liability that cannot be excluded under Applicable Law, including liability for fraud or for death or personal injury caused by our negligence.

14.1You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the Services, or your infringement of a third party’s rights.

15.1We may amend these Terms. The current version is always published at planfreezy.com/terms with its effective date.

15.2Where a change materially affects your rights or what a paid subscription provides, we will give you notice in the app or by email before it takes effect. Continuing to use the Services after that date means you accept the change; if you do not, you may cancel and, where the change reduces what you paid for, ask for a pro rata refund of the unused period.

16.1These Terms are governed by the laws of India.

16.2Before starting proceedings, please raise the matter with us at hello@planfreezy.com so we can try to resolve it. Most things are settled this way.

16.3Subject to clause 16.2, the courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

17.1Grievances under these Terms, or under the Information Technology Act, 2000 and the rules made under it, may be addressed to our Grievance Officer at hello@planfreezy.comwith the subject line “Grievance”. We respond within 15 days of receipt.
